4. General Privacy Policy for Patients

The confidentiality and due protection of the personal information entrusted to PROBIOMED is of the utmost importance for us. PROBIOMED is committed to manage your personal data in a responsible way and in compliance with the provisions of the Federal Law for the Protection of Personal Data Held by Private Parties (hereinafter the “Law”) and other applicable regulations.

PROBIOMED requires to collect certain personal data to carry out the intrinsic activities to its commercial activity and line of business. PROBIOMED has a legal and social obligation to comply with sufficient legal and security measures to protect the personal data it has collected for the purposes described in this privacy policy.

All the above is done with the aim of assuring you full control and decision over your personal data. Therefore, we recommend that you read the following information carefully.

4.1. Data responsible.

PROBIOMED S.A. de C.V. is a company incorporated in compliance with Mexican laws, located at 499 Ejército Nacional Ave., Granada, Miguel Hidalgo, 02020, CDMX, Mexico.

4.2. Collected personal and sensitive data.

By being part of our patient community, we may collect and process certain information that may be personally identifiable about you. Among this information, it may be included, but not limited to, the following:

1) Identification data: full name, personal telephone number, age, gender and date of birth.

2) Present and future health data: allergies, diseases, surgical interventions, family records, etcetera.

We may collect your personal data in different ways: when you provide them directly to us, when you visit our website or use our online services and when we obtain information through other sources permitted by Law.

4.3. Purpose of Data Processing.

Your personal data may be used for the following purposes related to your integration to our patient community:

  • Identification.
  • Pre-diagnosis.
  • Market research and product promotions.
  • Information of our advances, promotions, events and, in general, keep in touch with you.
  • Consultations, research and reviews in relation to the complaints or claims you present.
  • Statistical records.
  • Reports to the health authorities regarding possible adverse reactions or unexpected effects of our products.
  • Advertising, promotional and market research.

4.4. Data transfer.

Your personal information will not be transferred without your prior consent.

The personal data collected by any electronic or printed means for the purposes of production processes, marketing, market research and/or promotion of our products, as well as those derived from contractual and/or labor relations, will be treated under the terms of the Law, for storage, identification, administration, analysis, operation and/or disclosure. These data can be sent to third parties with contractual relationships with us. For this case, in the corresponding PROBIOMED agreement, it will be included a clause that guarantees that third parties grant the level of protection of personal data required by the Law.

Likewise, in order to fulfill the purpose(s) previously described or others legally claimed or requested by the competent authorities, PROBIOMED may transfer certain information to third parties and to the aforesaid authorities.

At all times, PROBIOMED will safeguard the confidentiality of the data and the processing thereof in such a way that your privacy is protected in terms of the Law, guaranteeing compliance with this notice by the company and by those third parties with whom it maintains a legal relationship to the adequate provision of their services.

4.5. Exercise of ARCO rights.

In accordance with the provisions of the Law, you or your legal representative may exercise the rights of access, rectification, cancellation and opposition (hereinafter ARCO rights) by sending the corresponding request to the email address privacidad@probiomed.com.mx where specialized staff will attend you timely.

4.6. Revocation of Consent and limitation of use or disclosure.

You can revoke at any time the consent you have given us for the processing of your personal data, as long as it is not necessary to fulfill obligations derived from our legal relationship, so that we stop using or disclosing them. You can also limit their use or disclosure. To do this, you must send a request to the email privacidad@probiomed.com.mx.

4.7. Changes to the Privacy Policy.

Any change or modification to this policy may be made by this company at any time and will be published on the website www.probiomed.com.mx.

4.8. Privacy Committee.

The Data Privacy Committee will provide you with the necessary attention for the exercise of your ARCO rights and will ensure the protection of your personal data within the organization.
